The following terms apply in addition to the above Terms and Conditions and govern participation in the Theory Test Nerds Affiliate Programme (the “Programme”).
“Company”, “we”, “us”, “our” refers to Theory Test Nerds.
“Affiliate”, “you”, “your” refers to the individual or business approved to participate in the Programme.
“Affiliate Link” means the unique tracking link provided to you.
“Commission” means the percentage of qualifying sales payable to the Affiliate.
16.1 Participation is subject to approval at our sole discretion.
16.2 Affiliates must be at least 18 years old and legally capable of entering into binding contracts.
16.3 We reserve the right to reject, suspend, or remove any Affiliate at any time without explanation.
17.1 Participation in the Programme does not create a partnership, employment relationship, agency, or joint venture.
17.2 Affiliates must not represent themselves as acting on behalf of Theory Test Nerds.
18.1 Affiliates earn commission on qualifying sales generated through their Affiliate Link at the rate displayed on the Theory Test Nerds website or Affiliate dashboard at the time of the sale, unless otherwise agreed in writing.
18.2 A qualifying sale is a completed purchase that is not cancelled, refunded, or charged back and whose order status has not changed within 3 days of the purchase date.
18.3 Commissions are calculated excluding VAT, delivery charges, refunds, and discounts.
18.4 Commission payments are made monthly and may be subject to a minimum payout threshold.
18.5 Affiliates are responsible for providing accurate payment information. We are not liable for delayed or failed payments caused by incorrect details.
18.6 We reserve the right to withhold or reverse commissions where fraud, abuse, self-referrals, or breaches of these Terms are suspected.
19.1 Affiliates may promote Theory Test Nerds using approved marketing materials, their Affiliate Link, and original content.
19.2 Affiliates must not:
Make false, misleading, or exaggerated claims about products or pass rates
Imply endorsement, approval, or affiliation with the DVSA unless explicitly authorised
Use spam, unsolicited messages, or misleading advertisements
Bid on our brand name or close variations in paid advertising without written consent
Use unauthorised discount codes or publish codes on coupon websites without permission
19.3 All promotional content aimed at learner drivers must be responsible, accurate, and compliant with UK advertising and consumer protection laws.
20.1 Affiliates may be issued a unique discount code for their audience.
20.2 Discount codes may be shared publicly, provided they are promoted in conjunction with the Affiliate’s unique Affiliate Link. Commission will only be payable where the customer completes their purchase via the Affiliate Link.
21.1 We use cookies and tracking technologies to attribute referrals.
21.2 Commissions are only payable where tracking functions correctly. Browser settings, ad blockers, or cleared cookies may affect tracking accuracy.
22.1 All trademarks, branding, and marketing assets remain the property of Theory Test Nerds.
22.2 Affiliates are granted a limited, non-exclusive, revocable licence to use approved materials solely for participation in the Programme.
23.1 Affiliates must comply with all applicable UK laws, including:
Consumer Protection from Unfair Trading Regulations
Advertising Standards Authority (ASA) rules
UK GDPR and data protection legislation
23.2 Affiliates must clearly disclose their affiliate relationship where required (e.g. “This post contains affiliate links”).
24.1 Either party may terminate Affiliate participation at any time, with or without notice.
24.2 Upon termination, Affiliates must immediately stop using Affiliate Links and promotional materials.
24.3 Outstanding commissions may be withheld or forfeited where termination results from a breach of these Terms.
25.1 We are not liable for indirect, incidental, or consequential losses arising from participation in the Programme.
25.2 Our total liability to an Affiliate shall not exceed the total commissions paid to that Affiliate in the previous 12 months.
